General Business and Booking Conditions

1. ACKNOWLEDGEMENT AND AGREEMENT TO THE GENERAL BUSINESS AND BOOKING CONDITIONS


The business and booking conditions which appear below are binding for all booking parties and clients of on-line hotel booking portal ESTEC managed by ESTEC s.r.o. - CZECH INCOMING TOUR OPERATOR & HOTEL MANAGEMENT COMPANY with Head Office at Vaníčkova 5/1, 169 00 Prague 6, CZECH REPUBLIC under identification number 15890597 (hereinafter referred to as ESTEC). Prior to binding confirmation of the booking (click on the icon ‘CONFIRM RESERVATION’) every client is required to confirm by ticking the appropriate box that he has been informed of the reservation and cancellation conditions that he agrees to them. The conditions are binding for the booking client as well as for those clients for whom the hotel reservation or other tourist service has been ordered by the booking party.

2. ELIGIBILITY TO BOOK THROUGH THE ESTEC PORTAL

By CONFIRMATION OF THE RESERVATION on the ESTEC portal the ordering client confirms, that he is minimum of 18 years old, that he is legally eligible and that there are no obstacles and reasons to prevent him to book accommodation and services of the ESTEC portal on the basis of these GENERAL BUSINESS AND BOOKING CONDITIONS for himself or his clients. The client by CONFIRMATION OF THE RESERVATION accepts a financial responsibility for reservations made and services, booked, accepts responsibility for the use of his name together with other personal and other details in relation to other clients and accepts responsibility using his credit card, which is used for the payment of the reserved hotel and booked services. The client by CONFIRMATION OF THE RESERVATION confirms, that all input information regarding the booking party or the clients for whom the hotel reservation and other services booked is correct and true.

3. CONFIRMATION OF THE RESERVATION

On binding confirmation of the reservation by the ordering party in the on-line ESTEC booking system, there is, after the checking of the payment, an e-mail sent to the client to confirm the reservation with a statement of the reservation number. By confirmation of the reservation number and confirmation of the payment there is an agreement entered into between the client and ESTEC s.r.o. in respect of hotel booking or of provision of other tourist services on the basis of the stated conditions.

4. PAYMENT

The hotels and services booked in this way must be paid prior to accommodation in the hotel or prior to use of the booked service.
  • BY CREDIT CARD

  • The on-line hotel booking system ESTEC managed by ESTEC s.r.o. enables secure on-line payments for booked services by MASTERCARD and VISA credit cards (including MAESTRO and VISA Elektron) through worldwide transaction processing specialist GLOBAL PAYMENTS (www.globalpaymentsinc.com) and its secure on-line payment portal Pay MUZO operating in adherence to the most stringent safety standards 3-D Secure. The actual credit card details are submitted for authorization and payment procession by secure means directly between the client and GLOBAL PAYMENTS-Pay MUZO. ESTEC does not have access to the client’s credit card details.
  • BANK TRANSFER

  • On-line hotel booking system ESTEC operated by ESTEC s.r.o. also enables payment for the booked services under the supposition that the hotel booking will be made more than 14 days prior to arrival to the hotel or prior to the use of the service. The payment must be made by the client so as the amount for the booking of the hotel or the ordered service being credited to the account of ESTEC s.r.o. within 7 days of the booking of the hotel or the service. Where this is not the case, the reservation of the hotel or the service will be automatically cancelled.

5. HOTEL ACCOMMODATION VOUCHER

After a successful processing of a credit card payment for a booked hotel or booked services or after accreditation of the payment onto the ESTEC account in a case of a bank transfer, the client is to receive BOOKING INFORMATION by e-mail with an option to print out the HOTEL VOUCHER. The booking party or client is obliged to print out the HOTEL VOUCHER and submit it when signing in into the booked hotel. Without submission of the HOTEL VOUCHER by the ordering party or by the client the accommodation does not have to be provided by the hotel. In a case of cancellation of the booked hotel or service by the ordering party or the client such formerly printed HOTEL VOUCHERS are invalidated.

6. CURRENCY

All hotel and services prices are stated in EUR. The total amount for booked hotels and services is also stated in EUR. In a case of credit card payment the actual settlement of the total amount for the booked hotel or services is automatically completed in CZK (Czech crowns) on the basis of up-to-date daily exchange rate of EUR and CZK as set by the Czech National Bank (www.cnb.cz). In the case of bank transfer payment the settlement is completed in EUR or CZK (Czech Republic booking parties).

7. CANCELLATION CONDITIONS

  • CANCELLATION – WITHOUT CHARGE

    (cancellation 4 days or more prior to the date of the beginning of confirmed booking)
    It is possible to cancel the booked hotel or service reservation WITHOUT CHARGE in a case of cancellation or the hotel or service booking 4 days or more prior to the arrival in the reserved hotel or prior to the beginning of use of the first booked service.
    In case of hotel or service reservation by credit card payment ESTEC makes repayment to the credit card account of the ordering party within 10 days. In a case of bank transfer payment ESTEC reimburses the sum due into the bank account of the ordering party within 10 days.
  • CANCELLATION WITH CHARGES EQUIVALENT TO THE PRICE OF THE FIRST NIGHT OF THE HOTEL RESERVATION

    (cancellation within 3 days prior to the beginning of confirmed booking)
    In a case of cancellation of booking of hotel or service within the period of 3 days to arrival into the booked hotel or prior to use of the first booked service ESTEC charges cancellation fee equivalent to price for 1 night of hotel booking. This cancellation charge is then deducted from the financial sum returned to the credit card or bank account of the ordering party.
  • FAILURE TO CANCEL THE HOTEL BOOKING – CHARGES EQUAL TO THE ENTIRE PRICE OF HOTEL OR SERVICE BOOKING

    (failure to honour reservation without prior cancellation)
    In a case of failure to honour a reservation without prior cancellation ESTEC charges cancellation fees to the amount of 100% of total price of the hotel reservation or booked services. Payments settled by credit card or bank transfer of the booking party are in this case taken as a contribution towards the settlement of the cancellation fees.

Cancellation of the hotel reservation or booked service is possible to make through an e-mail designated BOOKING INFORMATION which is received by every ordering party or client immediately on making a reservation. In the e-mail BOOKING INFORMATION it is necessary to click on the link to access the reservation made by the ordering party on the ESTEC booking portal. After the details of the reservation have been displayed on the ESTEC portal, click on the icon CANCEL RESERVATION.

ESTEC will confirm the processing of the cancellation by displaying information on the portal and by sending a reservation-cancellation confirmation to the e-mail address of the booking party.

It is possible in extreme cases to make the cancellation of the hotel reservation or of a booked service in writing by sending an e-mail to reservations@estec.cz e-mail address. The cancellation of reservation sent in writing by e-mail becomes valid on the return of an e-mail confirmation of the reservation cancellation from ESTEC to the ordering party. Telephone cancellation is not sufficient and is invalid.

In a case you want to cancel the hotel reservation at the booked hotel or the booked service at the place of the supplier of the service, this is also insufficient and invalid.

8. RIGHTS AND OBLIGATIONS OF THE BOOKING PARTY

TRAVEL DOCUMENTS

The booking party or client is responsible for the validity of travel documents and validity of visas if the client is a citizen of a state from which visas are required for journeys to the Czech Republic.

USE OF ON-LINE BOOKING PORTAL ESTEC

The content of the portal can be used by the booking party and clients exclusively for booking of hotels and services in adherence to the GENERAL BUSINESS AND BOOKING CONDITIONS.
Any other use of the content of the ESTEC portal is possible only with a written agreement of ESTEC s.r.o.

9. RIGHTS AND OBLIGATIONS OF THE PROVIDER

PROVISION OF SERVICES

ESTEC is responsible for the reservation and provision of accommodation at a booked hotel and for the provision of booked services on the basis of CONFIRMATION OF THE RESERVATION and on the basis of PAYMENT CONFIRMATION and for duly booked and paid-for services. Only in the case extreme and unpredictable circumstances has ESTEC the right to provide the clients with a substitute accommodation and that only in the same or higher category and in the similar or better location, in accordance with international regulations for tourist industry.

PROTECTION OF PERSONAL DETAILS OF THE BOOKING PARTY

ESTEC is obliged to handle personal details submitted of the booking party and clients in adherence to the legal provisions of personal data protection. ESTEC is under obligation not to provide any personal data to third persons for marketing or other purposes not in connection with the subject matter of hotel reservation or booked services.

ESTEC PORTAL INFORMATION

ESTEC regularly updates information regarding the hotels and services on offer. All information is published on the portal according to best endeavours on the basis of hotel information and service suppliers that are responsible for the information provided.

10. INSURANCE

ESTEC recommends its clients to seek travel insurance cover prior to journey to the Czech Republic in case of late cancellation of reserved accommodation or booked services inside a period of less than 4 days before the beginning of a confirmed reservation for health or other reasons acceptable to the insurance company.
The cover is also recommended for reason of reimbursement of expenditure in the event of therapeutic expenditure in the Czech Republic in case of an accident or illness.

11. CLAIMS

In the case of any complaints and claims of the booking party of clients regarding the provision of services of the ESTEC portal suppliers, it is necessary to report to ESTEC without delay and in writing, by e-mail, on reservations@estec.cz or by telephone to the ESTEC s.r.o. telephone number +420 233 107 511.

12. CHANGES TO THE CONDITIONS

THE GENERAL BUSINESS AND BOOKING CONDITIONS are subject to change and amendment without prior warning. Any confirmed reservations and booked services always adhere to conditions valid at that given moment in CONFIRMATION OF THE RESERVATION.
